Terms and Conditions

These terms apply when you use the Underwater Filming Guy website or book a service with us. They are intended to keep things clear and fair for everyone.
In these terms, “UFG”, “we”, “us” and “our” mean Stephen Hughes, trading as Underwater Filming Guy, ABN 15 169 473 660. “You” means the person booking or participating in a UFG service.
By making a booking, you confirm that you have read and accepted these terms.
1. Our services
UFG provides underwater swimming footage, stroke analysis, coaching feedback and related services.
Our feedback is educational in nature. It is designed to help swimmers better understand their technique, but it is not medical, physiotherapy or other healthcare advice.
Swimming improvement varies from person to person. We will provide our honest professional assessment, but we cannot guarantee a particular improvement, performance result or outcome.
2. Bookings and payment
A booking is confirmed when:
we have accepted the booking
Prices will be clearly communicated as we confirm your booking. Unless stated otherwise, prices are in Australian dollars and include GST where applicable.
Any remaining balance after the session must be paid within 7 days.
3. Cancellations and rescheduling
We understand that plans sometimes change.
If you need to cancel or reschedule, please contact us as soon as possible via email
We will always try to be reasonable, particularly where illness, emergencies or circumstances outside your control are involved.
Any cancellation charge will reflect the notice provided and the reasonable costs or losses associated with the cancelled booking.
If we need to cancel because of illness, unsafe conditions, pool availability, equipment failure or another circumstance outside our reasonable control, we will offer to reschedule the session or refund the affected service.
Nothing in this section limits any rights you may have under the Australian Consumer Law.
4. Health and safety
Swimming and pool activities involve physical effort and some inherent risks.
You are responsible for deciding whether you are physically able to participate. Please tell us before the session about any injury, medical condition, disability or other issue that may affect your safety or require reasonable adjustments.
You must follow all reasonable safety instructions given by UFG staff and the rules of the swimming facility.
Please stop participating and tell us immediately if you feel unwell, unsafe or unable to continue.
We may pause or end a session if we reasonably believe it would be unsafe to continue.
5. Children and young swimmers
Anyone under 18 must have their booking approved by a parent or legal guardian.
A parent, guardian or another responsible adult may also be required to attend the session, depending on the swimmer’s age and the rules of the facility.
Consent to participate does not automatically include consent for a child’s footage to be used publicly. Any public or promotional use will require separate, express permission from the child’s parent or legal guardian.
6. Filming and delivery of footage
Filming is a central part of the UFG service. By booking a filming session, you agree to being recorded for the purpose of providing the service, including stroke analysis, coaching feedback and preparation of your video.
We aim to provide completed footage within 7 days. Occasionally, technical problems or circumstances outside our control may cause delays. If that happens, we will let you know and work with you on a reasonable solution.
Please download and safely store any files we send you. We may retain session footage for 1 year, after which it may be securely deleted.
7. Public and social media use of footage
Booking a session does not give UFG automatic permission to use your footage on social media, our website, in advertising or in other public content.
We will only use identifiable footage publicly if you, or a parent or legal guardian where the swimmer is under 18, have given us separate, express permission in writing.
You can say no without it affecting the service you receive.
You may withdraw that permission for future use by contacting us. We will take reasonable steps to stop using the footage in new content and to remove it from channels we control where practical. We may not be able to retrieve copies that have already been shared, downloaded or reposted by other people.
Where agreed with you, we may crop, edit or de-identify footage before using it.
8. Privacy
We collect the information reasonably needed to manage bookings, communicate with you and provide our services. This may include your name, contact details, payment information and swimming footage.
We will handle your information with care and will not sell it to third parties.

9. Ownership and permitted use
You may use the footage and analysis supplied to you for your own personal, non-commercial swimming, training and coaching purposes.
Unless otherwise agreed, UFG retains ownership of the analysis, graphics, written feedback, coaching resources and edited materials we create.
You may share your completed video with your personal coach. Please contact us before reproducing, selling, publishing or using our analysis or materials for a commercial purpose.
Any material you supply to us must be yours to share, or you must have permission from the person who owns it.
10. Australian Consumer Law
Our services come with rights and guarantees that may apply under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.
If there is a problem with our service, please contact us. We will assess the circumstances and work with you to provide an appropriate solution, which may include correcting the service, rescheduling, a partial refund or a full refund where required by law.
11. Responsibility and liability
To the extent permitted by law, UFG is not responsible for loss caused by:
information you did not provide to us;
your failure to follow reasonable safety or coaching instructions;
using our feedback in a way that was not intended; or
events outside our reasonable control.
Nothing in these terms limits liability where it would be unlawful to do so, including any rights available under the Australian Consumer Law.
12. Website information
We take reasonable care to keep the information on our website useful and accurate. However, general website content may not be suitable for every swimmer and should not replace advice based on your individual circumstances.
Links to other websites are provided for convenience. We do not control those websites and are not responsible for their content, availability or privacy practices.
13. Concerns and complaints
If something has not gone as expected, please contact us first so we have an opportunity to understand the issue and put things right.

14. Changes to these terms
We may update these terms occasionally. The terms applying to a booking will generally be those provided or available when the booking was confirmed, unless a change is required by law or you agree otherwise.
The latest version will be available on our website with the date it was last updated.
15. Governing law
These terms are governed by the laws of Western Australia. The parties submit to the courts and tribunals with jurisdiction in Western Australia.
